Acuerdos fuertes y d\u00e9biles\nfueron encontrados dentro de la misma\nempresa y dentro del mismo sector, y\nalgunos de los acuerdos m\u00e1s s\u00f3lidos\nson con empresas medianas.<\/li><li>Algunos acuerdos pueden dejar a los\npueblos ind\u00edgenas en una peor situaci\u00f3n\nque en la que estar\u00edan sin un acuerdo.\nPor ejemplo, si bien la ley nacional\nreconoce el derecho legal de los\nciudadanos a participar en un proceso\nde legislaci\u00f3n ambiental, un acuerdo\naustraliano proh\u00edbe a la comunidad\npresentar objeciones, reclamos o\napelaciones a cualquier autoridad\ngubernamental bajo cualquier tipo de\nlegislaci\u00f3n, incluida la legislaci\u00f3n\nambiental - esencialmente eliminando\nsus derechos como ciudadanos.&nbsp;<\/li><li>Una percepci\u00f3n err\u00f3nea com\u00fan es que\nlas fortalezas en algunas \u00e1reas de un\nacuerdo probablemente reflejen compensaciones en otras \u00e1reas. En general se encontr\u00f3, sin embargo, que los acuerdos eran\ns\u00f3lidos de manera generalizada en todo el conjunto de temas o d\u00e9biles de manera generalizada.\nPor ejemplo, si los beneficios financieros eran m\u00ednimos, es probable que las disposiciones\nambientales tambi\u00e9n fueran malas.&nbsp;<\/li><li class=\"translation-block\">El r\u00e9gimen legal es importante pero no definitivo. Si bien se han alcanzado algunos acuerdos s\u00f3lidos en territorios de la\nNTA, tambi\u00e9n ha habido muchos acuerdos d\u00e9biles en esas \u00e1reas; por el contrario,\u00a0no hubo\nacuerdos d\u00e9biles\u00a0en el Territorio del Norte, donde el veto comunitario es posible bajo la ley.<\/li><li>La capacidad de la comunidad importa; se produjeron acuerdos s\u00f3lidos a pesar de reg\u00edmenes\npol\u00edticos desfavorables donde las comunidades pudieron acceder a redes pol\u00edticas regionales\nfuertes con los recursos financieros y t\u00e9cnicos necesarios para apoyar las negociaciones, hacer\n&#039;amenazas cre\u00edbles&#039; de acci\u00f3n pol\u00edtica directa y construir sobre estrategias legales regionales y\nprecedentes de acuerdos s\u00f3lidos. Se desarroll\u00f3\nuna escala num\u00e9rica de -1 a +6 para cada uno de los\nsiguientes elementos de los acuerdos:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Protecci\u00f3n del patrimonio cultural;<\/li><li>Participaci\u00f3n en la gesti\u00f3n ambiental;<\/li><li>Reparto de ingresos\/regal\u00edas;<\/li><li>Empleo y formaci\u00f3n de abor\u00edgenes;<\/li><li>Oportunidades de desarrollo empresarial;<\/li><li>Uso de la tierra, acceso a la tierra y reconocimiento\nde los derechos sobre la tierra; e<\/li><li>Implementaci\u00f3n del acuerdo.<\/li><\/ul>\n\n\n\n<p class=\"translation-block\">Esta escala no es cumulativa. Los acuerdos fueron posicionados en el punto m\u00e1s alto de la escala en el que se ubican. Por ejemplo, el \u00e1rea de\u00a0<em>gesti\u00f3n ambiental<\/em>fue dividida de la siguiente manera:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>(-1) Disposiciones que limitan los derechos\nexistentes<\/li><li>(0) No existen disposiciones<\/li><li>(1) La empresa minera se compromete con las\npartes abor\u00edgenes a cumplir con la legislaci\u00f3n\nambiental<\/li><li>(2) La empresa se compromete a consultar con el\npueblo abor\u00edgen afectado<\/li><li>(3) Las partes abor\u00edgenes tienen derecho a acceder y evaluar de manera independiente la informaci\u00f3n sobre sistemas y problemas ambientales<\/li><li>(4) Las partes abor\u00edgenes pueden sugerir formas de mejorar los sistemas de gesti\u00f3n ambiental, y el operador del proyecto debe tomar en cuenta sus sugerencias<\/li><li>(5) Toma de decisiones conjunta sobre algunos o todos los temas relacionados a gesti\u00f3n ambiental<\/li><li>(6) Las partes abor\u00edgenes tienen la capacidad de\nactuar unilateralmente para ocuparse de las\npreocupaciones o problemas ambientales asociados con un proyecto<\/li><\/ul>\n\n\n\n<p><\/p>\n<\/div>\n<\/div>\n\n\n\n<p>El Dr. O&#039;Faircheallaigh ofrece algunas recomendaciones\npara construir acuerdos m\u00e1s s\u00f3lidos con mejores\nresultados para las comunidades.
