Este derecho se afirma en el contexto de la autodeterminaci\u00f3n y el\nreconocimiento de que los pueblos ind\u00edgenas han sufrido injusticias hist\u00f3ricas. El siguiente texto del\npre\u00e1mbulo de la DNUDPI establece el contexto de estos derechos:<\/p>\n\n\n\n<p><em>&quot;Preocupada por el hecho de que los pueblos ind\u00edgenas han sufrido injusticias hist\u00f3ricas como resultado,\nentre otras cosas, de la colonizaci\u00f3n y de haber sido despose\u00eddos de sus tierras, territorios y recursos, lo\nque les ha impedido ejercer, en particular, su derecho al desarrollo de conformidad con sus propias\nnecesidades e intereses...<\/em><\/p>\n\n\n\n<p><em>Reconociendo la urgente necesidad de respetar y promover los derechos intr\u00ednsecos de los pueblos\nind\u00edgenas, que derivan de sus estructuras pol\u00edticas, econ\u00f3micas y sociales y de sus culturas, de sus\ntradiciones espirituales, de su historia y de su filosof\u00eda, especialmente los derechos a sus tierras,\nterritorios y recursos...<\/em><\/p>\n\n\n\n<p><em>Convencida de que si los pueblos ind\u00edgenas controlan los acontecimientos que los afecten a ellos y a sus\ntierras, territorios y recursos podr\u00e1n mantener y reforzar sus instituciones, culturas y tradiciones y\npromover su desarrollo de acuerdo con sus aspiraciones y necesidades...&quot;<\/em> <\/p>\n\n\n\n<p>Adem\u00e1s de la obligaci\u00f3n moral de respetar los derechos\nhumanos, el participar y respetar los resultados de los\nprocesos de CLPI tambi\u00e9n es una manera de minimizar y\ntransformar el conflicto y la violencia que los gobiernos y\nlas industrias han impuesto hist\u00f3ricamente sobre los\npueblos ind\u00edgenas.<\/p>\n\n\n\n<figure class=\"wp-block-pullquote alignleft\"><blockquote class=\"has-text-color has-virtue-primary-light-color\"><p>El CLPI es el fundamento\npara un trato justo y\ndemocr\u00e1tico entre\ncomunidades y empresas.<\/p><cite>Vincent Ekka, pueblos Kurux (Oraon)\nde la India; Jefe del Departamento de\nEstudios Tribales, Instituto Social Indio,\nNueva Delhi, India<\/cite><\/blockquote><\/figure>\n\n\n\n<p>Ignorar los deseos de la comunidad tambi\u00e9n es un mal\nnegocio. <a href=\"https:\/\/www.csrm.uq.edu.au\/media\/docs\/603\/Costs_of_Conflict_Davis-Franks.pdf\">Investigaciones realizadas<\/a> por la Iniciativa de\nResponsabilidad Social Corporativa de la Harvard Kennedy\nSchool y el Centro de Responsabilidad Social en Miner\u00eda del\nInstituto de Minerales Sostenibles de la Universidad de\nQueensland en Australia encontraron que las demoras\ndebido a protestas pueden ser costosas: alrededor de USD\n10,000 por d\u00eda en la exploraci\u00f3n temprana, alrededor de USD 50,000 por d\u00eda en exploraci\u00f3n avanzada y hasta USD 20 millones por semana de paros durante las\noperaciones.
